This shocking new Colorado bill would let workers enjoy marijuana at work

Consuming marijuana at work legally is something most people thought they would never live to see, but it may actually happen here in Colorado soon.

Newly proposed house bill 1152 filed in Colorado would prevent employers from "adverse action against an employee based on the employee's use of marijuana," according to the Colorado General Assembly.

In 2012, Colorado made history with amendment 64 which legalized the recreational use of marijuana for adults over the age of 21.

Despite the fact that the consumption of cannabis is legal in Colorado, federally marijuana remains illegal.

As marijuana becomes more popular, crowds are embracing new products. While marijuana flower remains the top product up for sale, other markets are growing.

As tracked by cannabis data platform Headset, marijuana flower sales grew from $4.92 billion in 2020 to $5.49 billion in 2021, according to Headset. Still, its share of the market fell, with pre-rolls, edibles, and more taking a cut.

 

The report, provided by MJBizDaily, reveals a variety of interesting findings. Marijuana flower sales experienced a price drop across states like California, Colorado, Michigan, Nevada, Oregon, and Washington. This is expected, with prices increasing the minute states launch legal markets, and then a price drop once the market finds its footing and normalizes.

It appears shoppers are becoming more knowledgable of the products they purchase, with dispensary workers reporting flower-buying habits shifting according to things like terpenes and other cannabinoids. These trends fluctuate depending on location; for example, on the East Coast, consumers purchase according to potency.

“The one thing that’s consistent is that the primary purchase decision is potency,” said Mike Bibbey, vice president of Ethos Cannabis, a marijuana retail business in Massachusetts and Pennsylvania.

More than 40% of people admit to doing this while using weed or alcohol

While more than half of drivers said they did not get behind the wheel while intoxicated, 42% admitted they did.

A recent report revealed that more than 40% of U.S. drivers who use both alcohol and marijuana reported driving under the influence of one or both of the substances, according to a new study.

Researchers used data from 34,514 drivers aged 16 and up who reported past-year alcohol and cannabis use. They answered questions as part of the National Survey on Drug Use and Health from 2016 to 2019.

While more than half of respondents said they did not get behind the wheel while intoxicated, 42% admitted they did.

The study also found drivers who used both substances were nearly three times more likely to drive while under the influence of marijuana and more than 3.5 times as likely to drive under the influence of both alcohol and cannabis.

Previous studies have concluded that both alcohol and cannabis can impair cognitive function and motor coordination, making it dangerous for anyone under the influence to get behind the wheel, especially younger drivers with less experience.

Colorado employers would no longer be able to fire their workers for using cannabis if a new bill passes

House Bill 1152 would also require employers to let their employees consume medical marijuana while at work, though there are exceptions for people whose jobs are in dangerous fields.

House Bill 1152 would also require employers to let their workers consume medical marijuana while on the job. The legislation would include exceptions for workers whose jobs are in dangerous fields or require fine motor skills, such as positions involving the use of heavy machinery.

“Marijuana is legal in Colorado,” said state Rep. Brianna Titone, an Arvada Democrat and prime sponsor of the bill. “And what people do in their spare time that doesn’t impact their work shouldn’t really be a problem for them. They should be able to enjoy the legal things that we have here in Colorado and not be penalized for it.”

The bill seeks to answer a workplace question that has been swirling in Colorado since voters passed Amendment 64 in 2012, legalizing the sale and use of recreational cannabis. Most states that have legalized medicinal and recreational pot leave the question over how to handle employees’ marijuana use up to employers, according to the National Conference of State Legislatures. 

Nevada and New Jersey are two exceptions. In New Jersey, employers can prohibit employees from using cannabis while on the job or showing up to work impaired. But they are not allowed to penalize an employee solely because of their off-the-clock recreational cannabis use.

Thai Health Minister signs removal of cannabis and hemp from drug list

 

Public Health Minister Anutin Charnvirakul signed an announcement to remove cannabis and hemp from its drugs list on Tuesday and the change will take effect 120 days after being published in the Royal Gazette.

Mr Anutin said the Narcotics Control Board endorsed the Public Health Ministry’s draft announcement on the list of Category 5 narcotics and the Food and Drug Administration received an approval letter from the Justice Ministry for it to finalize the announcement.

He said the announcement will then be published in the Royal Gazette and will take effect 120 days afterwards.

The move paves the way for households to grow the plant, which will be allowed after they notify the authority.

Nearly 1 In 10 New Jobs In This State Came From The Cannabis Industry

An analysis of state labor shows that, in this state, almost 1 out of 10 jobs was created by the medical marijuana industry.

Legal marijuana is good for business. According to an analysis of state labor from Missouri, nearly 1 in 10 new jobs was linked to the state’s recently functional medical marijuana industry.

The report shows some details of medical cannabis’s first year of operations, calculated between December 2020 and December 2021, showing that medical cannabis created 7,000 new jobs. A total of 77,600 jobs were created overall.

“Missouri’s medical cannabis industry is delivering on its promise of not only providing safe, affordable and convenient access for patients but also helping to infuse the state’s economy with sizable investment and millions in new tax revenue,” said Andrew Mullins, executive director of MoCannTrade.

Ski slopes on federal lands in legal states have to walk a tightrope

You want to allow cananbis use but your business sits on Federal land, now what?

Ski resorts are caught in the middle of murky legal issues surrounding state and federal cannabis policies.

China Peak Mountain resorts have been forced to position some workers to enforce federal cannabis policies around their property. The recent happenings at this establishment make it a perfect example to describe the contrasting state and federal laws.

The Cannabis Policy at China Peak Mountain

China Peak Mountain is a ski resort in California, located 110 kilometers northwest of Fresno. However, it operates primarily on federal lands. Therein lies the dilemma.

California cannabis legislation permits the recreational and medical use, sales, and cultivation of cannabis plants, but federal laws do not. Cannabis is a Schedule I substance according to the Controlled Substances Act. Other substances in this group include heroin, psychedelics, and cocaine.

This patchwork of cannabis policies has left ski resorts like China Peak Mountain in a confused state, unsure of which cannabis consumption laws to stick to. The Fresno-based resort currently adheres to federal laws and frowns against all forms of cannabis consumption on its grounds.

Legislation introduced to allow medical cannabis in Tennessee

The state will give oversight of the medical cannabis program that will include the in-state cultivation, processing and sale of cannabis.

NASHVILLE, TN (WSMV) - State Rep. Jason Powell filed legislation on Monday to propose an amendment to the Tennessee Constitution to allow medical cannabis, according to a news release.

Powell, D-Nashville, said if the constitutional amendment is passed it would allow Tennesseans to use medical cannabis legally for approved medical conditions including cancer, epilepsy and multiple sclerosis.

The state will give oversight of the medical cannabis program that will include the in-state cultivation, processing and sale of cannabis. The House Joint Resolution filed Monday will establish a 4% tax on the retail sale of medical cannabis with a portion specifically directed to assist military veterans’ health care.

“Tennesseans should have access to a comprehensive medical cannabis program in our state. No Tennessean suffering from an approved medical condition should have to drive hours out of state to purchase medical cannabis,” Powell said in a news release. “Furthermore, Tennesseans should be able to legally grow and sell medical cannabis here in Tennessee. I firmly believe an amendment to the Tennessee Constitution is the best path for legalizing medical cannabis in Tennessee. Voters should have the opportunity to decide this issue and I simply ask my legislative colleagues to give Tennesseans the choice to vote on a medical cannabis program.”

Powell voted for recent medical marijuana legislation in Tennessee but was a vocal critical that the legislation did not go far enough to help Tennesseans in need.

Cannabis Impairs Your Ability to Think Says a New Study, Except They Admit They Don't Really Have Any Evidence to Support It

A new reefer madness study on cannabis reveals there is not much evidence to the claims.

Did you hear about the latest study that claims, “using cannabis has negative impact on your ability to think’ and that ‘it may continue after you stopped using’. Yes, in essence, the study suggests that by using cannabis you will experience a detrimental effect on your cognition and that it may be permanent irrespective if you are “youth” or “adult”

Of course, one would expect that with such outlandish claims that at the very minimal the researchers would provide substantial evidence, however, by their own admission the “quality of evidence is low or moderate” despite them claiming that it was “of high quality”.

Furthermore, none of the media publications that covered the research posted any data on the findings but simply regurgitate the same drivel as what the official study said in its PR release.  

In today’s article, we’re going to be taking a closer look at some modern day Reefer Madness and how this anti-cannabis rhetoric becomes a part of the national conversation.

As you can see, that what the study did was utilize Meta-analyses on particular papers found on the databases of PubMed, PsycINFO, Web of Science and Google Scholar. They then took all of these studies and compiled them to compare all the data.

Cannabis-based epilepsy medicine Epidyolex approved for use on Scottish NHS

 

Scottish epilepsy patients as young as two could be given new cannabis-based medication today approved for use on the NHS.

Health bosses have given the green light to Epidyolex, which can help treat the symptoms of a rare genetic disease affecting around one in 10,000 people.

Tuberous sclerosis complex (TSC) causes tumours to grow in the body and around 80% of patients develop epilepsy from it, typically in their first year of life.

Additionally, for the majority of people, their condition doesn’t respond to standard anti-seizure medication – making today’s Scottish Medical Consortium decision a potential game-changer.

Scotland has become the second UK nation to approve the oral solution for use, following Wales.

Cannabis consumer activists comment on legalization hearings in Harrisburg

Warwick officer arrested for selling marijuana

The GBI Southwestern Regional Drug Enforcement Office arrested a Warwick Police Officer for selling marijuana while on duty and in uniform.

Two counts of sale/distribution of marijuana, one count possession with intent to distribute marijuana, four counts possession of a firearm during the commission of a felony, three counts violation of oath of office, and two counts use of a communication device during the commission of a felony.

The GBI SWRDEO received information that Mitchell was selling marijuana while on duty and in uniform as a police officer for the Warwick Police Department. During the investigation, agents began obtaining marijuana from Mitchell in Worth County and in Lee County.

The investigation culminated with the arrest of Mitchell at the Warwick Police Department and a search of the vehicle Mitchell was driving. Additional marijuana, scales, and plastic bags were located within the vehicle. Mitchell was booked into the Worth County Jail. This investigation is ongoing and will be turned over to the District Attorney’s Office when complete.

The SWRDEO would like to thank the investigative support and cooperation provided by the Crisp County Sheriff’s Office, the Lee County Sheriff’s Office, the Worth County Sheriff’s Office, and the Warwick Police Department.

Long-Term Cannabis Smoking Appears to Alter Lung Function, But Not Like Tobacco

A long-term study tracking just over a thousand participants has found regular cannabis smoking can change the function of your lungs as you age. Unlike smoking a cigarette, however, cannabis seems to impact a person's breathing in a slightly different way. 

Over adulthood, tobacco smoking is associated with a progressive decline in how much air you can force from your lungs in a given amount of time. In comparison, cannabis smoking in the current study was connected to higher lung volumes in total.

Ultimately, the authors found both changes lead to similar end results – constricting airways and leading to hyperinflation and gas trapping.

These patterns of lung function match previous results from the same cohort, which were collected 13 years earlier when the participants were 32 years of age.

"Although the effects of cannabis were detrimental, the pattern of lung function changes was not the same," says respiratory specialist Bob Hancox from the University of Otago in New Zealand.

"The research found that prolonged cannabis use led to over-inflated lungs and increased the resistance to airflow to a greater extent than tobacco."

New Brunswick endorses first eight marijuana businesses

 

NEW BRUNSWICK, NJ – The city has endorsed eight applications to open recreational marijuana businesses here.

The next step is for the applicants to obtain approval from the state.

The applicants approved for licenses are Earth & Ivy, Puffin Store, Maryjayne's Touch, NB Green Delivery, LBOZ, NBFC, DC Vitality, and Fathom Cannabis, according to a public notice.

The city is permitting cannabis retailers in CAN-RD zones. The city is supporting Earth & Ivy, 355 George St.; Puffin Store, 382 George St. and Maryjayne's Touch, 70 Easton St. for retail licenses.

Did Biden forget his promise to decriminalize weed? Here’s why advocates are concerned

The fact that Biden’s Commerce Sec. is not focused on marijuana legalization has provoked cannabis advocates to question the President’s willingness to keep his promise.

President Joe Biden’s Commerce Secretary Gina Raimondo revealed in a recent interview with Politico that she has no updates on cannabis decriminalization that was promised during the presidential campaign, reported Marijuana Moment.

When a reporter asked if cannabis should be descheduled, pointing out that some businesses don’t want to see this as it would likely increase competition creating across state markets, Raimondo replied that the matter is “so far afield from anything that I’m working on.” As Raimondo’s focus continues to be trade and supply chain management, marijuana is apparently not yet on her agenda.

Just recently, a new poll conducted by YouGov and The Economist, revealed that more than half of the U.S. adult population concurs that President Biden has made little to no progress on his crucial campaign promise to decriminalize cannabis during his first year in office.

The survey revealed that the majority of U.S. residents also don’t hold out much hope that the president will make progress on this important reform in 2022, which is in line with Raimondo’s response.

Interestingly, Raimondo, who was a governor of Rhode Island before joining the Biden administration, skillfully dealt with marijuana policies, backing a plan in her budget proposal to legalize recreational cannabis via a state-run model. Her successor, Gov. Dan McKee just recently proposed a measure in his budget that would support a more conventional recreational cannabis market.

Smokable medical cannabis coming to Minnesota in March

It’s been a long time coming, and finally, Minnesota will have smokable cannabis available for medical patients.

Medical cannabis patients in Minnesota will see smokable cannabis flower in licensed retailers beginning next month, according to an announcement from state regulators. The Minnesota Department of Health said in a statement on Tuesday that the state’s medical cannabis dispensaries will be able to offer dried cannabis flower on March 1.

Dispensaries will offer pre-packaged dried cannabis flower and pre-rolled joints in a variety of strains and cannabinoid potency levels. Registered patients will be able to purchase up to a 90-day supply of cannabis at one time. Previously, state regulations only permitted patients to use processed cannabis products such as extracts, distillates, capsules and topicals.

It won’t be as easy as visiting a dispensary and picking out a favorite strain of bud, however. Under Minnesota’s medical cannabis regulations, patients must first complete a consultation with a medical cannabis dispensary pharmacist to change the type of medical marijuana they receive. 

“In preparation for the change, registered patients interested in smokable cannabis can make an appointment for a consultation with a medical cannabis dispensary pharmacist beginning Feb. 1 so they will be pre-approved to buy pre-packaged dried flower and pre-rolls once available,” the health department wrote in its statement. Patients have the option of either in-person or virtual consultations to satisfy the requirement.

Smokable cannabis flower will only be available to patients and caregivers ages 21 and older who are registered with the state’s medical cannabis program. Minnesota Commissioner of Health Jan Malcolm urged patients who are considering switching to cannabis flower to seek the advice of a health care professional before making the change.
